What is the EB-1 Visa?

Formally known as the Employment-Based Immigration: First Preference, the EB-1 is a pathway to U.S. residency for priority workers who hold key positions in their fields or exhibit extraordinary talent. 

Unlike other employment-based visas, the EB-1 does not require a labor certification from the Department of Labor confirming that no U.S. workers are available for the position.

EB-1 Visa Requirements

The core requirements and evidence criteria depend on the subgroup you’re applying for.

  • For EB-1A, you need to show you’re among the small percentage at the top of your field and have the intent to continue growing.

    In terms of evidence, you’ll need either a one-time achievement like a Pulitzer, Oscar, Olympic Medal, or meet three of the ten evidence criteria.

  • For EB-1B, applicants need at least three years of experience in teaching or researching and must be entering the U.S. for a tenure-track teaching position/comparable research position.

    Applicants need to meet two of the six evidence criteria for this subgroup. You can work with a Manhattan EB-1 lawyer to identify the best criteria to target for your application.

  • For EB-1C, you must’ve been employed outside of the U.S. for at least one year in the three years preceding your application.
